New Money Laundering complaint against the Luxembourg liquidator Yvette Hamilius.

Panama-Papers informs about new insights and new evidence.

Landsbanki case: Criminal complaint against Ms. Yvette Hamilius and Landsbanki Bank in liquidation addressed to the public prosecutor in Paris
On 24 September 2015, Mr Van Ruymbeke ordered the case to be sent before the Criminal Correctional Court in Paris.  The Landsbanki Luxembourg Bank and several of its managers, were indicted principally (notably) for fraud, and on requisitions by the Procurator ( Attorney General ).
Mrs. Hamilius is not indicted as part of this procedure.
For years, Landsbanki and its liquidator have been harassing plaintiffs whilst attempting by various means to intimidate them and leading a strategy of moral and financial exhaustion, increasing defence costs.
Normally, following a judicial order and opening the debate in Criminal correctional Court, the judicial debate on civil interests must take place before the criminal court in Paris.
A court verdict reached on July 10, 2014 in the Grand Duchy of Luxembourg by the Council Chamber at the Court of Appeal of Luxembourg had also recognized the full jurisdiction of the French Court and Tribunals regarding everything concerning the case and the French proceedings were opened.
Using a manifestly inelegant manœuvre, the Landsbanki Luxembourg company in liquidation has started civil proceedings in order to obtain a condemnation of the civil parties before the Luxembourg courts and block the action of the civil parties in France.
This is all in a context where the liquidator has publicly denigrated the work of Mr. Van Ruymbeke, where the Luxembourg Court has deliberately refused to open a criminal case whether against Landsbanki, despite the fact that the Luxembourg subsidiary served as a logistical base for offenses committed in Icelandic, instigated and supported various illegal operations including those revealed in Panama Papers, manipulated and falsified bank accounts to preserve a false image of a triple A bank, incited dozens of people to subscribe to the Equity Release scheme falsely promising them a chimeric return on investment, sometimes tax-efficient solutions to succession without the slightest regard for the social reality of families, become victims of these predatory acts.

Despite the searing reality of these fraudulent practices, Mrs Hamilius lodged no complaint to restore public order and justice neither in her country, nor in France or Spain.  She has never ceased her continued support of former directors in the scandalous Equity release scheme conducted by them at the expense of tens of dozens of savers.

By launching a new judicial procedure without any prior efforts of conciliation, Mrs Hamilius, is attempting to short circuit French justice.
This is an unnecessary process anyway, since she already has an enforceable title, since all the Equity Release loans were signed notary acts, but she knows judgments were ruled in France prohibiting the realization of assets as long as the Criminal Correctional Court in Paris has not ruled on the infringements alleged against the Bank and its Directors.

Even more serious, the judicial manoeuvres are aimed at realizing the assets that are the fruit of the offenses to which Landsbanki will be judged shortly in Paris.
Exhausted from all those years of legal harassment, denial, and (unhealthy protection), the victims of this fraudulent behaviour have lodged a new complaint with the prosecutor of the French Republic, for having discredited the French judiciary, for intimidation of the victims, harassment and money laundering  and attempted money laundering, attempted fraud to judicial proceedings .
The complaint was lodged with the Prosecutor of Paris and its content will also be communicated to the Luxembourg judicial authorities with no great illusion given the attitude of Luxembourg prosecutors who refused to investigate and prosecute the directors of Landsbanki Luxembourg and / or their accomplices although there is material evidence to conduct serious investigations in Luxembourg.

The LANDSBANKI Affair

Judge Renaud Van Ruymbeke, has referred the bank directors and the bank to the Correctional Tribunal in Paris which is an historic step.

The immoral and illegal practices of the predators of LANDSBANKI LUXEMBOURG, are now finally to stand before the judges.

On September 25th 2015 Judge Van Ruymbeke, released an historic judgment, sending Landsbanki Bank and a number of it’s directors, Bjorgolfur GUDMUNSSON, Gunnar THORODDSEN, Torben BJERREGAARD, and the managers Olle LINDFORS, Morten NIELSEN, Thomas NIELSEN, Vincent FAILLY and the sales representatives, Robert ANTHONY and Pascal MARCEROU to the Correctional Court of Paris.

The meticulous, determined, ruling delivered by the instructing magistrate unravels the whole fraud process at the core of the Equity Release Scheme and exposes in detail, the international scale of the devious, unlawful practices of the Landsbanki Group.
The judgment equally criticizes the behavior of the liquidator Mrs. HAMILIUS.

The referral to the Correctional Tribunal is an essential step for the dozens of victims of the shameful practices in the banking world.
The victims are elderly people whose retirement has been ruined and the end of their lives destroyed, wrecked, by fault of the Icelandic banks in Luxembourg and those assisting them.

This Court order is additionally a blow for the liquidator,
Mrs. HAMILIUS, who did not want to see anything, for the Luxembourg judiciary which refused to investigate in depth and which never listened to any of the victims, preferring to shield the practices of the Icelandic banks in Luxembourg with a protective cover of inadmissible silence, but also it is the fault of the Commercial Tribunal of Luxembourg who did not bother to listen to the victims nor to their lawyers.

Soon an historic case concerning the failings in the banking world will open in Paris. In the meantime it is high time that the Luxembourg authorities take full account of the scandal of Icelandic banks, the considerable human damage inflicted and that finally the question of compensation for the damages suffered by the victims of these procedures will be taken into account.

A press conference will be organized in the coming days which will provide a full explanation of this historic case.

Le juge Renaud VAN RUYMBEKE renvoie les dirigeants de la Banque et la Banque devant le tribunal correctionnel à Paris – Une étape historique

Les pratiques immorales et illégales des prédateurs de la Banque LANDSBANKI enfin devant les juges

Ce 24 septembre 2015, le juge VAN RUYMBEKE a prononcé une ordonnance historique renvoyant la banque LANDSBANKI et nombre de ses dirigeants MM. Bjorgolfur GUDMUNSSON,  Gunnar THORODDSEN, Torben BJERREGAARD, les cadres Olle LINDFORS, Morten NIELSEN, Thomas NIELSEN, Vincent FAILLY et les apporteurs d’affaires, Henry ANTHONY  et Pascal MARCEROU devant le Tribunal correctionnel de Paris.

L’ordonnance du magistrat instructeur longuement motivée démonte le processus d’escroquerie à la base du processus d’equity release scheme et expose par le détail la dérive des pratiques délictueuseS du groupe Landsbanki à l’échelle internationale. L’ordonnance critique aussi le comportement de la liquidatrice Madame Hamilius.

Ce renvoi devant le Tribunal correctionnel est une étape essentielle pour des dizaines de victimes des pratiques honteuses du monde bancaire. Ces victimes sont des personnes âgées dont la retraite a été abîmée et la fin de vie détruite et gâchée par la faute des  banques islandaises et de ceux qui les ont servies.

Cette ordonnance est aussi un camouflet pour la liquidatrice, Madame Hamilius, qui n’a rien voulu voir, pour le parquet luxembourgeois qui a refusé d’enquêter de façon approfondie et qui n’a eu aucune écoute pour les victimes, préférant entourer les pratiques des banques islandaises au Luxembourg d’une chape de silence judiciaire inadmissible, mais aussi pour le tribunal de commerce de Luxembourg qui n’a pas pris la peine d’écouter la parole des victimes et de ses conseils.

Demain, un procès historique va s’ouvrir à Paris concernant les dérives de certains milieux bancaires. Dans l’intervalle, il est plus que temps que les autorités luxembourgeoises prennent la pleine mesure du scandale des banques islandaises et des dégâts humains considérables commis et qu’enfin, la question de la réparation du préjudice subi par les victimes de ces procédures soit prise en compte.

REPORT ON MORTGAGE RELEASE LANDSBANKI MARCH 12TH, 2015.
1.Purpose of this report As experts in finance and accounting, we have been required to analyze the operative of commercialization of a complex financial product denominated MORTGAGE RELEASE by the Luxembourg subsidiary of the Icelandic bank LANDSBANKI. First, we must indicate that the mentioned Icelandic bank suspended payments and was intervened by the authorities of the country as the rest of bank entities were during the months of September and October 20081 . We start with this comment because we must be aware of the fact that the three Icelandic banks (LANDSBANKI, KAUPTHING and GLITNIR) bankrupted and intervened on, are a worldwide example of all kind of “malpractice” in banks which may be classified in some legal environment as criminal practices. In fact, the Spanish Courts had to decide, for instance, in many trials about the incorrect and misleading commercialization of the preferred shares of LANDSBANKI and KAUPTHING among retail investors of our country. Although public liability was required, in this case, from the Spanish banks commercializing the preferred stock, it has to be pointed out that the “deception” to the customers could not be materialized since both banks denominated these preferred shares as capital notes 2 .
